Information on the protection of personal data

This notice informs you about the processing of your personal data by AHP and the rights to which you are entitled under the new data protection law.

Purposes and legal bases of data processing

We process your personal data in compliance with the EU General Data Protection Regulation (GDPR), the new German Federal Data Protection Act (BDSG) and all other relevant laws.

If you submit a request to our company AHP (e.g. request for an offer for a product), we need the information you provide for the reply and to assess the risk to be assumed by us. If a contract is concluded, we process this data for the execution of the contractual relationship, e.g. invoicing.

The conclusion or execution of the contract is not possible without the processing of your personal data.

In addition, we require your personal data for an analysis of the entire customer relationship, for example for advice regarding a contract amendment or supplement, for goodwill decisions or for the provision of comprehensive information.

The legal basis for this processing of personal data for pre-contractual and contractual purposes is Art. 6 para. 1 lit. B DSGVO .

If we create statistics or analyses with these data categories, this is done on the basis of Art. 9 para. 2 lit. J DSGVO in conjunction with § 27 BDSG.

If personal data is required for special categories, we will obtain your consent in accordance with Art. 9 para. 2 lit. A in conjunction with Art. 7 DSGVO.

Consent that has been granted can be withdrawn at any time. This also applies to the revocation of declarations of consent that may have been given to us before the DSGVO came into force, i.e. before May 25, 2018. Withdrawal has no retroactive effect. It does not affect the legal validity of the data processing carried out on the basis of the previous consent until receipt of the revocation. This also applies to the legal validity of an automated individual decision concerning you made prior to receipt of the revocation.

We also process your data in order to protect our legitimate interests or those of third parties (Art. 6 (1) (F) DSGVO). This may be necessary in particular:

  • To ensure IT security and IT operations,
  • To advertise our own products and for market and opinion surveys,
  • To prevent and investigate criminal offenses, in particular we use data analyses to identify indications that may point to misuse.

In addition, we process personal data to fulfill legal obligations such as regulatory requirements, commercial and tax retention obligations or our duty to provide advice. In this case, the legal basis for the processing is the respective legal regulations in conjunction with Art. 6 para. 1 lit. C DSGVO.

If we wish to process your personal data for a purpose not mentioned above, we will inform you of this in accordance with the statutory provisions.

Duration of data storage

We delete your personal data as soon as it is no longer required for the above-mentioned purposes. Personal data may be retained for the period during which claims can be asserted against our company (statutory limitation period of three or up to thirty years). We also store your personal data insofar as we are legally obliged to do so. Corresponding proof and retention obligations arise from the German Commercial Code, the German Fiscal Code and the German Money Laundering Act, among others. The storage periods are up to ten years.

Your data protection rights

You can request information about the personal data stored about you at the above address. In addition, you can request a correction if we have stored incorrect data about you. You also have the right to request the completion of your personal data, taking into account the purposes of the processing, if we have stored incomplete data. You can also request the deletion of your data under certain conditions. You may also have the right to receive the data you have provided to us in a structured, commonly used and machine-readable format.

Right of objection

You have the right to object to the processing of your personal data for direct marketing purposes. If we process your data to protect legitimate interests, you can object to this processing if your particular situation gives rise to reasons that speak against data processing.

Right of appeal

You have the right to lodge a complaint with the above-mentioned data protection officer or a data protection supervisory authority.
